What BH is doing is perfectly legal. They are the sole importer for FMS. When we in the States buy from outside sources, we are parallel importing. The shop selling to us is in violation of the agreement.

There are many many many companies that have sole importing rights to thousands of products. Many manufacturers take a very strong stance against parallel importing and thus supporting their dealers. If they don't support their dealer, why should the dealer do its best to sell the product?

Another RC example is the foamies being sold by 3DHS. They are made by Skywing but 3DHS has an sole importer agreement with them so we can't buy from anyone else except 3DHS.

It is unfortunate that FMS chose BH to be their sole importer. On the flip side, there have been more and more 'sucess' stories from their customers so maybe things at BH have taken a turn for the better in terms of CS. Only time will tell.

It is also unfortunate that RC Castle (or was it PWRC) has decided to stop carrying FMS just because they have been told they cannot sell to the US. At no point was there mention of not being able to sell to the EU. Maybe EU just doesn't have the sale numbers required for RC Castle or PW RC to keep FMS planes in stock.

Vincent is 100% correct! As he stated, that it may be unfortunate that FMS chose BH as their sole US distributor (due to their very poor history of customer service), less than expected sales $$$ will eventually determine how long that agreement will remain in force.

Well that is at least one explanation. We will see what happens.

I have the nagging idea still that FMS might want to make BH the sole worldwide distributor but well probably they wont if they are a profit based company, even though they reside in Commie China.

BTW parallel importing here is generally thwarted by European set custom fees/import tax as well as VAT you have to pay,
especially as a private person since companies can deduct these taxes....

However there still is a big price difference which makes it often worthwhile.

An example : Buying in China, the FMS P-51 1700 mm would cost me:

468 US$ including shipping which constitutes 381.552 EUR.

Ordering in my own country the plane would cost me 441 EUR including shipping which is a whopping :

541.030 USD

So you can see why these matters do P. me off bigtime.

I don't think we'll ever know the truth to this situation.

FMS already had a distributor in NitroPlanes, whom I've bought a lot of planes from including FMS, who provided excellent customer support compared to BH. I have never purchased anything from BH because of their non-existent support.

I can't imagine that FMS didn't do their homework before selecting BH as their sole US distributor (poor customer support) so there must be some other reason they were chosen. Even if BH promised them the moon a manufacturer would be very leery putting all their eggs into one basket, especially with BH's reputation.

So this is why I say that we will never know the reason...perhaps FMS now owns a chunk of BH... who knows?

I hear what you are all saying, but here is one confusing thing.

When NP stopped carrying the "airfield" brand, we all have assumed that it is becuase FMS no longer wanted its products sold under a different brand and becuase BH now have the exclusive right to sell FMS products in the US (nothing terribly uncommon by that as others have pointed out).

yet all of a sudden I notice this on the NP website.

Clearly the older FMS 4CH SkyTrainer sold under the AeroSky brand name.

What gives?

This is new so something doesn't add up. Clearly the assumption that FMS didn't want its products sold under a different brand is not true (i.e. AeroSky??). Even more, if BH has exclusive rights to FMS, how is NP getting away with selling what is clearly an FMS product?

I dont know man but that plane may not be made by fms. It may have came from the same factory. Why would they go back to selling an older style plane with a 2 bladed prop when the newer ones have have the 3 bladed prop and better landing gears, but who knows

From the Consumer Affairs website.....

"In April 2011, the California Better Business Bureau listed them for having 367 complaints filed in 2011 up until the listing in April. MESSAGE FROM FMS to AROS (fellow member)

I spoke to my contact from FMS tonight about the Banana Hobby/PW-RC/RC Castle issue and here is what I was told just minutes ago. (I have paraphrased due to some translation/grammar but this is the majority of the message)...

"We feel very suprised that people on the forums are saying that FMS won't sell to PW-RC and RC Castle, as we have been receiving emails about this issue. The truth is, PW-RC and RC Castle feel they are unable to order from us due to Banana Hobby's low prices. We have tried to persuade them, even offering a special price for them. We were told that their profit is too small to compare with the banana hobby price point.

We are very much willing to and would like to continue to do business with PW-RC and RC Castle without question. We don't quite understand why they only wish to order spare parts from us. I will talk to them myself and hope we can come to an understanding. The forum community has misunderstood that we don't want PW-RC and RC Castle to sell our product but that is simply not true! Please help me to explain to our loyal customers on RCG that FMS would like to continue to sell to them very very much, as we are well aware of their wonderful history of customer service and support."
