Feds Trying To Kill Town Too Tough To Die

This is a bizarre story of the Forest Service doing everything they can to keep the town of Tombstone from repairing its only source of water, which happens to be in a National "Forest". Of course, National Forests didn't exist when the water source was first tapped in 1881.

Now they spotted a Spotted Owl and even more nonsense is sure to ensue.

Tombstone is trying to repair a 26-mile pipeline that has brought mountain spring water into the city since 1881. It was damaged during last summer's Monument Fire and monsoon rains that brought mud, water and boulders crashing down the denuded slopes.
The Miller Peak Wilderness Area, where owls nest in the trees above Tombstone's pipeline, was hit particularly hard. Sections of pipeline simply vanished, and Tombstone's reservoir ran dry by August.

Kevin Rudd, project manager for the Tombstone pipeline, said the repaired pipeline needs to be shored up or it surely will be washed away when the monsoon rains return next month. Planned tasks for the shovel brigade include reinforcing the spring and diverting its flow by using boulders, sand, downed trees and other flood debris.

As for the owl, nobody could say for certain after the fire whether it would return. But it's the big reason why the Forest Service wouldn't simply hand Tombstone a permit to use heavy construction equipment to fix the pipeline. Tombstone responded by taking the feds to court. Since then, the conflict has escalated, taking on a life of its own.

More recently, workers were stopped from using a wheel barrow. Rangers say the wheel barrow is “mechanized” and “might damage wilderness and disturb endangered species.” The feds are blocking emergency repairs that are critical to Tombstone’s survival.

So the environmeddlers and their Federal faces are forcing the town to return to the stone age in order to effect repairs.... because of a bird.

People must climb the mountain in blistering heat to move rocks and dirt using hand tools instead of chain saws and excavators.

The Feds and relevant agencies should be sued for any injuries due to this and the cost of suing them. In addition, each functionary needs a team of people investigating their properties for violations. They wage lawfare against all of us with impunity. It's time to wage lawfare against them personally and see how they like it.

If we cannot get them to undo the legal destruction of our actual rights, then it's only fair each of them are held to the letter of it in their own lives. This is easier for us than them, since there are more of us and relatively few of them. Allowing for very detailed focus in them on their personal compliance.

That's just crazy. I've used chainsaws and vehicles on Forestry land before.

We keep hearing the excuse 'we're not demanding you wear hair shirts'. A ban on power tools, excavators and even wheelbarrows to fix a municipal water line is about as hairshirt as it gets.

No, the bird was an added bonus to the Feds. The roadblocks were put in place well before they recently spotted the bird.

We have our own owl on our property - thankfully its not a Spotted one or no telling what the Feds would make us do to protect it.

It's probably happening exactly because Brewer is governor. The Feds don't pass up any opportunity to sue or harrass AZ since the state tried to start carding suspected illegals. And then Brewer pointed her finger at Obama and we all know how he reacts to perceived disrespect.

Considering the feds have no boots on the ground to enforce EPA rules, why don't state rules and enforcement apply ? Let the feds appeal through proper channels...

Shoot shovel and shut up is a common response to discovery of protected species on private land.

The inevitable disincentive of the removal of property rights in the name of 'protection'. Anyone who has ever struggled with city or county over property issues has had the barest taste of the risk cost and power the Feds will focus on you.

What I find amazing is that those who defend evolution at all cost ignore the very theory allows for natural selection. It is nothing more than a tool to cripple industry and human development.

The Feds don't play through 'channels'. And I guess since it's a national forest, the Fedgov has teeth.

This government needs a reminder of who serves whom...

Our government now confuses "Servicing the Public" with "being of service to the public." In the first we bend over to their needs and in the second they assist us in the business we must do.
