HobbyKing won't give 2600 lottery prize after winning

I got an email that I had won the Futaba 18MZH transmitter, value around $2600.

A week later I receive an email saying they have made a mistake and I did not win the prize

After a lot of mailing back and forth they are now offering me $25 compensation.

My initial question:

A few mails later in which I asked them when they would ship the transmitter since it had been more than a week since I received confirmation of winning the Futaba TX, this is what I got:

Hello Angelo,

First I would like to thank you for the time you put into answering my questions.
But frankly my response to your last email is not as kind as I would like it to be. That's quite a big mistake, the kind of mistake that a big company like HobbyKing can not afford to make.

Your first response to me was: "We have verified that you are the winner of our lottery".

That kind of makes me wonder what the word verified really means. In my vocabulary it means that HobbyKing has checked and conluded that I am without a doubt the winner in the lottery.

Imagine you are told you have won a 2600 euro prize in a lottery, next you are told you have to wait untill it's processed. And more than a week later, long after it should have been shipped, you get to hear. "Sorry we made a mistake, here's your money back".

You wouldn't take that would you.

To be honest I am more than dissapointed in HobbyKing's thoroughness in taking care of this matter and therefore can not accept to just let this slide.

The way I see it I am within my rights as a customer to demand the prize that I was promised by HobbyKing.

You simply can not tell people they have won a prize and then withdraw it afterwards.

I will await your response and expect a well suited solution for this matter.

I truly appreciate the gesture but $25 dollars is quite a dissapointment if you compare it to the original value of the prize that was promised to me. I know for a fact that international law states that prizes won in a lottery can be claimed by the lottery winner no matter what. Since I am not the kind of person that likes time and money consuming lawsuits I am prepared to do a counter offer.

This is just incredible. How can a huge multinational company handle a case like this in this manner. It's not like they lose a huge amount of profit over this. I'm asking for $400 in goods on which they even still have a profit margin of probably anywhere near $100 so that's $300 plus shipping.
I think I'm being very reasonable here don't you.
HobbyKing you need a good kick in the ass for treating loyal customers this way.

After they sent me this last email I kinda broke down on the situation and told em I got so tired of the situation that I would settle for 50 to buy a new Axn from them. Guess what, not even a reaponse anymore. This really pisses me off.
I'm gonna make it my new goal in life to make them give me the prize that I am entitled to.
I would like to ask everyone who has had a run inn with Hobbyking in which they feel badly misstreated to send an email to me at quadflyer77@gmail.com containing your story and if possible the emails that were sent between HK and you.
With all these stories put together I and my lawyer will make a solid case against them to make em take their mistakes more seriously and solve them in a way that is appropriatly matched with our rights as a customer.

Please post this story on as many rc forums as possible and make people know how hobbyking can be when they stuff up. Theres to many people becoming victims of their mismanagement and monopoly position on the market.
They must be tought a lesson in human descency.

Why are you being reasonable? You entered the lottery and managed to gain $23 dollars which is $23 dollars more than most people.

Hobbyking made a mistake that shouldn't have happened but life is full of mistakes as Im sure you are aware.

I know it's a bitter pill to swallow that you won't get a new TX worth many thousands of dollars but at least you haven't lost anything . Furthermore, there is little point in going on about your international rights as thats going to get you nowhere. It's also fairly childish. Swallow you're pride and accept the mistake.

I am sorry if the above sounds rather harsh but I think you're being overly harsh on Hobbyking.

I can understand you being upset because i know i would of been too but afterwards i would of calmed down a bit and excepted their $25,i would of thought to myself i got my bonus points back plus another $25 on top,which is a bonus.

For you to say to them what you now wanted a whole FPV platform was laughable IMHO,come on now did you really think you were going to get that?or were you just trying it on and now your upset because they never went for it?

I'm sure if you checked the HK rules for this lottery you will see they are well within their rights not to give you anything,like the other guy has said it's a hard pill to sallow but it's got to be done,if not this isn't going to do you any good in the long run,life is to short to be this upset.

This is the same company that asks when you try to do a "no hassle return" if they decide not to take your item back if you want to just forfeit it or pay for return shipping.

Then when you try to find out in advance if the returns acceptable they never have a product specialist available try again in 3 hours.. until your out of the no hassle return window

Don't swallow your pride, don't accept their mistake, forgiveness is not something that should be given to corporations. forgiveness is for friends and family. You should be pissed and you shouldn't stand for it. Fact of the matter is you entered a contest and you won, then they did the old switcheroo last i checked that wasn't legal I Hope you report them to anyone and everyone that can lay some smack down on these junk pedallers

for your benefit and in particular #2 and #7....welcome to reality



1.Free Shipping is offered to prize winners, sent to the address used in their account settings. An entrant must ensure their address details are up to date in their HobbyKing account at time of entry. Re-sent shipments due to incorrect addresses will be charged to the customer.
2.If the number of entrants does not reach the threshold for the draw for a certain prize, Hobbyking reserve the right to cancel the draw, and all bonus points collected will be returned to all participants.
3.A customer's Hobby Lottery history can be viewed in their Hobbyking account under "Community / Media"
4.All prizes are covered by HobbyKing's regular warranty policies.
5.A limit is set for each draw as to how many tickets can be purchased per account. This will be clearly stated at the start of each draw. These limits will be set by Hobbyking and will not be changed after a draw has started.
6.All prizes will be dispatched to the winner within 5 days of announcement.

That's all well and good but they simply shouldn't have told him he won, then confirmed that he won....

in my eyes that's where they were committed to delivery. At that point the reward was promised and should be delivered.

That's just a load of crap. I'm sorry to say this but your response is quite gutless. If that is how you would let a big market controlling corporation with millions of dollars earned in a day's work walk over you, then I have one advice for you. GROW A PAIR!!
I wish HobbyKing thought the same way you do and just swallowed their pride and compensated in the way they should for the mistake they made.

That's exactly the reason why I will take em to war. After making a "promise" and even saying they VERIFIED I was the winner. there simply is no turning back from that "promise".

Honestly I wanted to make it easy on em. They could have just given the $400 and I would have ordered it myself, but that way they wouldn't get their profit margin so I even gave em that.
To make matters even worse, I sent them an email in conclusion to this whole mess saying I would settle for $50 so I could replace my AXN which I crashed recently. You know what they said. NOTHING, the basterds didn't even respond and that's been well over a month now.
I wouldn't treat a streetdog that way. And that's how they handle a loyal customer who they have wronged already.
Sorry man but that's not how you handle things, especially a company like HK. I say screw em an make em correct their mistake the way they should and come through on their promise.

If every lottery had rules like that they would never have a winner..
Have you checked the lottery winner page recently. For weeks they haven't revealed any winners they will all be unveiled. no winners have been declared since my winning the Futaba so I guess they are "working on a failsafe"
