So, anyone notice that the Supreme Court set Mortgage Bankers on the docket for December oral argument?

Well, if the NTSB follows Merrell and Gorman as the D.C. Circuit says it is statutorily bound to do, "adjudicatory interpretation" will be the dispositive issue.

"If" the FAA modified or contradicted a prior "rule" (advisory circular), per Alaska Hunters, it failed to publish for comment the adjudicatory interpretation that could be used to hose Trappy; but, if the Supreme Court overrules the D.C. Circuit, as it is likely to do, and finds that Congress specifically excluded interpretive rules from the APA, well, Crappy is well and truly hosed.

It should be an interesting Christmas for Crappy, and Dominic will be back, around then, from Sud America!

Although we did not find Christina, the search was performed with full approval of the FAA. Those guys jumped through hoops to get us into the air.

Oh, well, the NTSB is probably waiting on the Supremes to decide Perez v. mortgage Bankers, eh, Bm?

Then, it's on to Merrell deference and whether La Crap gets hosed...but, it's been a very good ride, eh?
