Drones used to monitor no smoking area

So I just heard from a guy I work with that his apartment complex is no smoking anywhere on the property and they monitor it with drones. If the guy flying the drone works for the apartment complex then doesnt that fall under commercial use?

I believe they are flying around the property looking for people smoking on their balconies or just outside on the property.

how tall is this building? I mean, wouldn't it be easier to just have the guy walk around with binoculars?

though the commercial-use stipulation is becoming obvious as a stupid , utterly abusive approach by the FAA. I mean it makes about as much sense as requiring commercial-use licensing for cameras, woodworking tools, paintbrushes, etc. Beause any sane human can fly a Bebop drone around a building safely with zero risk, and could make for a very useful common tool at home and in business (eg roof inspections, and 25,000 other uses)
