help --what to do

i bought a gyro on this site from a gentleman.i sent a m.o. he mailed package usps.it arrived--however the box is tore open and empty.it is then wrapped in a clear plastis bag that appologizes for mail being damaged.the bag is supplied by usps.what is my corse of action.?

File a claim with USPS. It was insured, right?

Try not make a big deal out of nothing.
